The Customer who places an order through the website, by phone or by email.
Goods means the items that the Purchaser undertakes to purchase from the Seller.
By contract we mean the contract between the Seller and the buyer for the sale and purchase of goods.
Terms and conditions means the terms and conditions of sale referred to in this agreement and all the special terms and conditions agreed in writing by the Seller.
*These products are not for use by or sale to persons under the age of 18. This products should be used only as directed on the label. They should not be used if you are pregnant or nursing. Consult with a physician before use if you have a serious medical condition or use prescription medications.
These terms and conditions apply to all contracts for the sale of goods by the Seller to the Purchaser and prevail over any other documentation or communication from the Purchaser.
Acceptance of the delivery of goods is proof of acceptance by the Purchaser of these terms and conditions.
Any variation of these terms and conditions (including any special conditions and conditions agreed between the parties) is not applicable unless agreed in writing by the Seller.
Any complaints must be addressed to the Seller’s address.
All orders of goods are considered as an offer by the Purchaser to purchase goods in accordance with these General Conditions and are objects to acceptance by the Seller.
The Seller can choose not to accept an order for any reason.
In the event that the goods ordered by the buyer were not available in stock, the Purchaser will be notified and given the possibility to wait until the products arrive in stock or cancel the order and receive a full refund within 30 days.
PRICE AND PAYMENT
The price of the asset is the one reported on the website. On the home page, before logging in to the retailers’ area, the price is available to the public. Shipping costs are not included.
The purchase price, including VAT and shipping costs, will be displayed in the Buyer’s cart before confirming the order.
After the order has been received, the Seller will confirm by e-mail:
the confirmation of the order
the confirmation of the shipment with the related invoice.
All orders with payment confirmed before 09:30 am will be shipped the same day.
We use the BRT courier and delivery times are as follows: 24/48 hours throughout Italy except islands and disadvantaged places.
In the event that the agreed delivery date can not be met, the Purchaser will be notified and can decide whether to agree on a new delivery date or whether to receive a full refund.
The Seller will take care to meet any agreed delivery date.
In any case, delivery times are not dependent on the Seller, who is not responsible for any losses, costs, damages or expenses incurred by the Purchaser or third parties, deriving directly or indirectly from failure to deliver on the estimated date.
The goods travel at the risk of the buyer, so we advise you to choose the insurance present in the purchase procedure of your reserved area.
The company reserves the right to periodically update prices on the website. The Seller will take care to guarantee prices at the moment when the Purchaser places an order.
The company reserves the right to collect the goods from the website at any time.
The Seller is not responsible for the collection of goods from the website or for refusing to process an order.
RIGHT OF WITHDRAWAL
Sales of products via the Internet are governed by the law D.Lgs n. 185 of 22/05/1999 which regulates the subject of distance contracts, ie carried out outside business premises.
This legislation establishes the right of withdrawal, ie the possibility for the purchaser to return the purchased product and to obtain the reimbursement of the expenses incurred. This right is reserved exclusively for natural persons final consumers, so it can not be exercised by legal persons and by natural persons acting for purposes related to their professional activity. The law sets a deadline for the return equal to 10 days from receipt of goods. The only costs to be borne by the buyer are the shipping costs of the product.
In case of withdrawal, we kindly ask you to follow the following procedures: send an email to email@example.com inserting the order number, the sales invoice or the receipt, a telephone contact and the reason for the withdrawal.
The product, the packaging and the contents of the box must be returned as new, intact and with all the accessories.
The product must not have been used but only viewed.
If the product is returned not respecting the previous points, it will be reimbursed according to the conditions of wear of the product, the packaging and the contents of the box.
Both shipping and return costs are the responsibility of the purchaser.
All our products are guaranteed for 12 months from the date of purchase, in case the product is sold the warranty covers for 3 months after the purchase – as shown in the sales receipt – (unless otherwise indicated) and must be shipped ex warehouse.
Returns must be sent in their original packaging with the permission of the sales department.
The guarantee will be managed within 10 days from the date of return of the goods.
Shipments are always to be paid by the customer, therefore we do not accept parcels on delivery, parcels in port, by registered mail or goods without original packaging.
Damages caused by improper use of the product or products where the warranty seal has been tampered with or removed are not guaranteed.
Materials subject to wear are not guaranteed.
In order to take advantage of the warranty on the goods purchased, you must keep the sales invoice or proof of purchase that will be sent attached to the product to be managed under warranty.
CHANGES TO TERMS
The Seller has the right to modify these conditions of sale at any time, but this right does not affect the existing terms and conditions accepted by the Buyer at the time of purchase.
APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are governed by and interpreted in accordance with Italian law and the parties will be subject to the exclusive jurisdiction of the Italian courts.
In the event of disputes, the place of jurisdiction is Milan.
